Quote Daddy — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Quote Daddy website, web application, and related services (collectively, the "Service"). The Service is operated by Market Equities Limited, a company incorporated in Ireland, with its registered office at Courtyard, Manor House, 3 Church Rd, Malahide, Co. Dublin, K36 AK25, Ireland ("Market Equities", "we", "us", or "our").
Please read these Terms carefully. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1. Important Notice — Not Financial or Investment Advice
The Service provides market data, news, charts, and related information for general informational and educational purposes only. Nothing on or through the Service constitutes, or is intended to constitute:
- investment, financial, trading, tax, legal, or accounting advice;
- a recommendation, solicitation, offer, or invitation to buy, sell, hold, or deal in any security, financial instrument, cryptocurrency, commodity, or other asset; or
- a representation that any security, strategy, or transaction is suitable for any particular person.
Market Equities is not a registered investment adviser, broker-dealer, financial adviser, or licensed financial institution, and does not provide personalised financial advice. You are solely responsible for your own investment decisions. You should obtain independent professional advice from a suitably qualified and licensed adviser before making any financial decision. Past performance is not a reliable indicator of future results, and the value of investments can go down as well as up.
You acknowledge and agree that you use any information obtained through the Service entirely at your own risk.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is not directed at, and may not be used by, persons under 18.
You are responsible for ensuring that your use of the Service is lawful in your jurisdiction. The Service may not be available, or may be restricted, in certain territories.
3. The Service
The Service allows users to, among other things, view market quotes and charts, build and manage watchlists, view financial news, and set informational price alerts. Specific features may be added, modified, or removed at any time.
Market data, quotes, news, fundamentals, and similar content are sourced from third-party data providers (including, without limitation, providers of equities, index, commodity, and cryptocurrency data and news). Such information:
- may be delayed, inaccurate, incomplete, interrupted, or unavailable;
- is not guaranteed to be real-time, error-free, or continuously available; and
- must not be relied upon for trading, transactional, or time-sensitive purposes.
We do not independently verify third-party data and are not responsible for its accuracy, completeness, timeliness, or availability.
4. Accounts and Security
To access certain features you must create an account. You agree to:
- provide accurate, current, and complete information;
- keep your login credentials confidential and not share them;
- be responsible for all activity that occurs under your account; and
- notify us promptly at [email protected] of any unauthorised use or security breach.
We may suspend, restrict, or terminate your account at any time in accordance with Section 12. You may close your account at any time through the Service or by contacting us.
5. Subscriptions, Free Plans, and Billing
The Service is currently offered with a free tier. We may introduce paid subscription plans or premium features in the future. Where paid plans are offered, the following applies:
- Fees and billing. Applicable fees, billing frequency (e.g. monthly or annual), and features will be presented to you before purchase. By subscribing, you authorise us (and our payment processors) to charge the applicable fees to your chosen payment method.
- Renewal. Paid subscriptions may renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time, effective at the end of the current billing period.
- Price changes. We may change subscription prices on reasonable advance notice; changes apply to subsequent billing periods.
- Taxes. Stated prices may exclude applicable VAT or other taxes, which will be added where required.
- Refunds and consumer rights. Where you are a consumer in the EU/EEA, you may have a statutory right of withdrawal ("cooling-off period") for certain purchases. Nothing in these Terms removes or limits mandatory consumer rights you have under applicable law. Outside such mandatory rights, fees are non-refundable except as expressly stated or required by law.
We use third-party payment processors and do not store full payment-card details ourselves.
6. Acceptable Use
You agree not to, and not to attempt to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- copy, scrape, harvest, redistribute, resell, or commercially exploit any market data, content, or other materials from the Service except as expressly permitted;
- reverse engineer, decompile, disassemble, or attempt to derive source code from the Service, except to the extent permitted by mandatory law;
- interfere with, disrupt, overload, or circumvent the security or integrity of the Service or its infrastructure (including via bots, scripts, denial-of-service, or excessive automated requests);
- access the Service through unauthorised automated means or exceed any rate limits;
- misrepresent your identity or impersonate any person or entity;
- upload or transmit malicious code; or
- use the Service in any way that violates the rights of others or any applicable law, including the terms of our third-party data providers.
We may monitor use for compliance and take any action we consider appropriate, including throttling, suspension, or termination.
7. Intellectual Property
The Service, including its software, design, branding, "Quote Daddy" name and logo, text, graphics, and compilation of content (excluding third-party data and user content), is owned by or licensed to Market Equities and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial purposes. No other rights are granted. All rights not expressly granted are reserved.
Third-party data, news, and content remain the property of their respective owners and are provided subject to their terms.
8. Third-Party Services and Links
The Service relies on and may link to third-party services, data providers, infrastructure, and websites (including hosting, authentication, and market-data providers). We do not control and are not responsible for third-party services or content, and your use of them may be subject to their own terms and privacy policies. We are not liable for any loss arising from your use of, or reliance on, any third-party service or content.
9. Disclaimers of Warranties
To the maximum extent permitted by applicable law, the Service and all content are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranties arising from course of dealing or usage.
Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, secure, timely, or error-free; (b) any data, quotes, news, or content will be accurate, complete, current, or reliable; (c) defects will be corrected; or (d) the Service is free of viruses or harmful components.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including mandatory rights of consumers in the EU/EEA.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- We (together with our officers, directors, employees, agents, and suppliers) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, trading or investment losses, or business opportunity, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
- In particular, and without limitation, we are not liable for any trading, investment, or financial losses of any kind arising from your use of, or reliance on, any data, content, alert, or information provided through the Service.
- Our total aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the total amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 100.
Nothing in these Terms limits or excludes our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be limited or excluded under applicable law. If you are a consumer, these Terms do not affect your mandatory statutory rights.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Market Equities and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of any law or third-party right; or (d) your investment or financial decisions. This Section does not apply to the extent a claim arises from our own breach, negligence, or wilful misconduct, and does not apply where you are acting as a consumer to the extent prohibited by law.
12. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service (in whole or in part) at any time, with or without notice, if we reasonably believe you have breached these Terms, created risk or legal exposure, or for operational, security, or legal reasons. You may stop using the Service and close your account at any time.
Upon termination, your licence to use the Service ends. Sections that by their nature should survive termination (including Sections 1, 7, 9, 10, 11, 13, and 14) will survive.
13. Changes to the Service and to These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. Where changes are material, we will take reasonable steps to notify you (for example, by posting the updated Terms with a new "Last updated" date or via the Service). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
14. Governing Law and Disputes
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes), are governed by and construed in accordance with the laws of Ireland.
The courts of Ireland shall have jurisdiction to settle any such dispute. However, if you are a consumer resident in the EU/EEA, you retain the benefit of any mandatory protections of the law of your country of residence, including the right to bring proceedings in, and rely on the mandatory consumer-protection laws of, your home jurisdiction. Nothing in this Section deprives you of such mandatory rights.
EU consumers may also have the right to use the European Commission's Online Dispute Resolution platform.
15. General
- Entire agreement. These Terms (together with the Privacy Policy and any plan-specific terms) constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
